## Body That Sets the Rate
The **Fair Work Commission** (FWC) sets the national minimum wage each year through its **Annual Wage Review** process. The Expert Panel of the Fair Work Commission conducts the review and hands down the determination (typically in late May or early June), with the new rate taking effect from 1 July of that year.
The legal basis is the *Fair Work Act 2009* (Cth), which requires the Commission to conduct an annual wage review and make a National Minimum Wage Order.
