The employee's long service leave entitlement is governed by Victorian state law (specifically the Long Service Leave Act 1992 (Vic)). 

The Fair Work Act 2009 (Cth) does not set long service leave entitlements as part of the National Employment Standards or otherwise provide a uniform national scheme. Entitlements instead continue to be determined by the state or territory legislation that applies based on the employee's location of work. Here, that jurisdiction is Victoria, so the relevant level of government is the State of Victoria.
