**Victorian state law (Long Service Leave Act 2018 (Vic))**

The employee’s long service leave entitlement is governed by Victorian state legislation, not by a uniform national rule under the Fair Work Act 2009 (Cth).  

Although the employer is a national-system employer covered by the Fair Work Act, that Act does not itself set a comprehensive long-service-leave scheme. Instead it preserves the operation of the relevant state and territory long-service-leave laws. Because the employee works in Victoria, the applicable law is therefore the Long Service Leave Act 2018 (Vic) (as amended and in force for FY2025-26).  

That Act (and any applicable modern award or enterprise agreement that may supplement it) determines how the entitlement is calculated, when it accrues, and how it is taken or paid out. No single Commonwealth figure applies uniformly across Australia.
