**Fair Work Act 2009 (Cth), ss 117 and 119**

**(a)** 4 weeks  
Under s 117(3) the scale is 1 week (<1 yr), 2 weeks (1–3 yrs), 3 weeks (3–5 yrs) or 4 weeks (>5 yrs). The employee has 6 years’ continuous service (>5 yrs) so the base period is 4 weeks. - ≥4 <5 yrs: 8 weeks  
- ≥5 <6 yrs: 10 weeks  
- ≥6 <7 yrs: 11 weeks  
- (higher bands continue to a 12-week cap at ≥10 yrs).  

Six years’ completed service falls in the “at least 6 but less than 7 years” band, which attracts 11 weeks. The employer is not a small business and the redundancy is genuine, so the NES redundancy entitlement applies in full.
